By accessing or using Learn+ ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

Learn+ is an AI-powered flashcard generation and study platform that allows users to:

- Generate flashcards from text, documents, or topics using artificial intelligence - Create, edit, and organize flashcards manually - Study using spaced repetition and active recall techniques - Share flashcards with other users - Track learning progress and statistics

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

**Account Creation:** To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

**Account Security:** You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

**Account Termination:** We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

**Credit System:** Learn+ uses a credit-based system for AI-generated flashcards. Each flashcard generated consumes one credit. Credits can be purchased through the platform.

**Pricing:** All prices are listed in USD and are subject to change. We will provide notice of any price changes before they take effect.

**Payment Processing:** Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.

**No Refunds:** Unless otherwise stated in our Refund Policy, all purchases are final and non-refundable. Please refer to our Refund Policy for detailed information.

**Your Content:** You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing the Service.

**Content Restrictions:** You agree not to submit content that: - Infringes on intellectual property rights - Is illegal, harmful, or offensive - Contains malware or malicious code - Violates any third party's privacy - Is false or misleading

**Content Moderation:** We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

**Our Property:** The Service and its original content, features, and functionality are owned by Learn+ and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

**Limited License:** We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

**Restrictions:** You may not: - Copy, modify, or distribute the Service - Reverse engineer or decompile the Service - Remove any copyright or proprietary notices - Use the Service for commercial purposes without authorization

**Nature of AI Content:** Flashcards and other content generated by our AI are provided for educational purposes. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

**No Guarantees:** We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You should verify important information independently.

**Your Responsibility:** You are responsible for reviewing and editing AI-generated content before use. You should not rely solely on AI-generated content for critical decisions.

You agree not to use the Service:

- In any way that violates any applicable law or regulation - To impersonate any person or entity - To interfere with or disrupt the Service - To attempt to gain unauthorized access to the Service - To collect user information without consent - To send unsolicited communications - To upload or transmit viruses or malicious code - To engage in any activity that could harm minors - To automate access to the Service without permission

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- MERCHANTABILITY - FITNESS FOR A PARTICULAR PURPOSE - NON-INFRINGEMENT - ACCURACY OR COMPLETENESS OF CONTENT

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARN+ SHALL NOT BE LIABLE FOR:

- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES - ANY DAMAGES RESULTING FROM YOUR USE OF THE SERVICE

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Learn+ and its officers, directors, employees, agents, and affiliates from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

- Your use of the Service - Your violation of these Terms - Your violation of any third party's rights - Your User Content

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in San Francisco County, California.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

- Posting the updated Terms on the Service - Updating the "Last Updated" date - Sending an email notification

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
